These Terms and Conditions (the “Agreement”) constitute a legally binding agreement between you (“User,” “Customer,” “Member”) and Travelmix Inc. (“Travelmix,” “Company,” “we,” “us,” or “our”), a Florida-based travel service provider specializing in hotel bookings. By accessing, browsing, registering, or using www.Travelmix.com (the “Website”) and our services, you acknowledge and agree to be legally bound by these Terms and Conditions, as well as all applicable laws and regulations.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE USING THE WEBSITE AND SERVICES.
1. LEGAL COMPLIANCE & COMPANY INFORMATION
1.1 Business Registration & Travel Seller Compliance
• Florida Seller of Travel Registration #: ST45324 in compliance with the Florida Sellers of Travel Act (Fla. Stat. §§ 559.927-559.939).
• Federal Trade Commission (FTC) Act, 15 U.S.C. § 45, which governs advertising and consumer protection.
• Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.), making this Agreement legally enforceable.
• Compliance with U.S. Department of Transportation (DOT) and Federal Aviation Administration (FAA) regulations related to travel.
1.2 Third-Party Suppliers & Role as an Intermediary
• Travelmix acts as an independent intermediary and does not own, manage, operate, or control hotels.
• Travelmix sources hotel listings through direct contracts with hotels, wholesalers, and third-party platforms.
• Under 47 U.S.C. § 230 (Communications Decency Act), Travelmix is not liable for third-party content, including pricing errors, hotel descriptions, or images provided by suppliers.
1.3 Payment Processing & Data Security
• Payments are processed securely through Stripe, Inc., a PCI-DSS compliant provider, as per the Electronic Fund Transfer Act (15 U.S.C. § 1693).
• Travelmix does not store or retain credit card information.
2. MEMBERSHIP TERMS & CONDITIONS
2.1 Membership Benefits & Eligibility
• Travelmix offers monthly and yearly subscription-based Memberships that provide access to exclusive discounted hotel rates.
• Memberships do not guarantee specific pricing, availability, or savings for any given booking.
2.2 Billing, Renewal, and Cancellation
• Membership fees are automatically charged at the start of each billing cycle in compliance with the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. § 501.201).
• Memberships automatically renew unless canceled before the next billing date.
• Travelmix reserves the right to modify Membership fees, features, or benefits at its sole discretion with notice.
2.3 No Refunds Policy
• All Membership fees are non-refundable, except where prohibited by law.
• Florida law (Fla. Stat. § 501.95) allows no-refund policies if they are clearly disclosed, as is the case in this Agreement.
2.4 Membership Termination by Travelmix
• Travelmix reserves the right to suspend or terminate any Membership due to:
• Violation of these Terms and Conditions
• Suspicion of fraudulent activity
• Abuse or misuse of the Travelmix platform
3. HOTEL BOOKINGS & TRANSACTIONS
3.1 Hotel Listings & Availability
• Hotel listings and availability are dynamic and subject to change.
• Travelmix does not guarantee the accuracy of hotel descriptions, amenities, or images, which are provided by third parties.
• Travelmix is not responsible for overbookings, operational failures, or service disruptions by hotels.
3.2 Pricing & Payment Terms
• Hotel prices fluctuate based on market conditions and supplier agreements.
• Full payment or deposit may be required at the time of booking, as dictated by hotel-specific policies.
• All applicable taxes, service fees, or charges are displayed before booking confirmation.
3.3 Cancellations, Modifications, and Refunds
• Each hotel has its own cancellation and modification policies, which the User must review before booking.
• Travelmix does not control or override hotel cancellation fees, refund policies, or penalties.
• Non-refundable bookings cannot be modified, canceled, or refunded.
3.4 No-Show & Early Departure Policy
• Hotels may charge a no-show fee, in compliance with Fla. Stat. § 501.204 (unfair trade practices).
• If a guest checks out early, the hotel may impose early departure fees.
4. DISCLAIMERS & LIMITATION OF LIABILITY
4.1 Limited Role & Liability Disclaimer
• Travelmix acts solely as an intermediary and is not responsible for:
• Hotel conditions, cleanliness, security, or service quality.
• Misrepresentations made by third-party hotel suppliers.
• Any incidents, damages, or losses occurring at a hotel property.
4.2 Force Majeure Clause
• Travelmix is not liable for service interruptions due to unforeseeable events, including but not limited to:
• Natural disasters (hurricanes, earthquakes, floods) – 42 U.S.C. § 5121 (FEMA Disaster Declaration Act).
• Government-imposed travel bans – 22 U.S.C. § 3904 (U.S. State Department Travel Advisories).
• Epidemics, pandemics, or health crises – 42 U.S.C. § 264 (CDC Travel Health Notices).
4.3 Indemnification
• Users agree to indemnify and hold harmless Travelmix against any claims, losses, damages, or liabilities arising from:
• User misuse of the platform
• Booking errors caused by third-party suppliers
• Legal disputes related to hotel stays
5. DISPUTE RESOLUTION & GOVERNING LAW
5.1 Governing Law
• This Agreement shall be governed by the laws of the State of Florida (Fla. Stat. § 48.193).
5.2 Mandatory Arbitration
• All disputes must be settled through binding arbitration in Florida per:
• Federal Arbitration Act (FAA, 9 U.S.C. § 1-16).
• Florida Arbitration Code (Fla. Stat. § 682.01-682.22).
• Users waive the right to sue in court or participate in class-action lawsuits.
6. ADDITIONAL LEGAL TERMS
6.1 Intellectual Property Rights
• Travelmix owns all intellectual property on its platform per U.S. Copyright Act (17 U.S.C. § 101 et seq.) and Lanham Act (15 U.S.C. § 1051 et seq.).
• Unauthorized use, copying, or distribution is strictly prohibited.
6.2 Modification of Terms
• Travelmix reserves the right to amend these Terms at any time.
• Continued use of the Website constitutes acceptance of the revised Terms.
6.3 Severability Clause
• If any provision of this Agreement is found unenforceable, the remainder shall remain in full force.

8. LEGAL ACKNOWLEDGMENT
BY USING TRAVELMIX.COM, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS. YOU WAIVE ANY RIGHT TO CLAIM UNCERTAINTY OR NON-ENFORCEABILITY.
